1. Overview
This website is operated by Framar International Inc, a Canadian company incorporated and registered in Canada, with Ontario Corporation Number 1473848 whose registered office is at 7873 Blackburn Parkway Niagara Falls, Ontario L2H 0A6.
Throughout the site, the terms “we”, “us”, and “our” refer to Framar International Inc. We offer this website, including all information, tools, and services available from this site, to you conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing Framar Products from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.
2. Acceptance of Terms
By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all terms and conditions, you may not access the website or use any services. Any new features or tools added to the store are also subject to these Terms.
We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of the website following any changes constitutes acceptance of those changes.
3. Online Store Terms
You represent that you are at least the age of majority in your jurisdiction. You may not use our products for any illegal or unauthorized purpose. Users must not upload, transmit, distribute, or otherwise make available any code, scripts, software, or technical material that may compromise, disrupt, or interfere with the security, integrity, or functionality of Framar systems, Shopify infrastructure, or customer data. This includes, without limitation, destructive code such as viruses, worms, Trojan horses, backdoors, malware, or any other harmful or unauthorized scripts. Framar may, at its sole discretion, block, remove, or restrict any code of any kind that it determines to be unsafe, unauthorized, or inconsistent with these Terms.
A breach of any Terms will result in immediate termination of your Services. A breach of any Terms will result in the immediate suspension or termination of your access to the Services. Framar reserves the right to pursue any and all legal remedies available, including injunctive relief, damages, and recovery of costs arising from the breach. Framar may also report unlawful conduct to the appropriate authorities and cooperate fully with any resulting investigations.
4. General Conditions
a. Right to Refuse Service. The Company reserves the right to refuse service to any individual or entity at any time and for any lawful reason. This right shall be exercised in compliance with applicable human rights legislation and without unlawful discrimination.
b. Data Transmission and Security. You acknowledge that any content you submit to the Service, excluding payment card information, may be transmitted unencrypted over various networks and may be subject to changes necessary to conform and adapt to technical requirements of connecting networks or devices. Payment card information is always encrypted during transmission and processed in accordance with applicable PCI‑DSS standards.
c. Privacy and Data Protection Compliance. The Company collects, uses, stores, and discloses personal information in accordance with all applicable privacy and data protection legislation, including: The Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy statutes in Canada. European Union / EEA / United Kingdom: The General Data Protection Regulation (GDPR) and UK GDPR, including lawful bases for processing, data subject rights, and cross‑border transfer requirements. United States: Applicable state privacy laws, including the California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), Utah Consumer Privacy Act (UCPA), and any other state privacy legislation governing the processing of personal information.
The Company implements administrative, technical, and physical safeguards appropriate to the sensitivity of the information. By using the Service, you consent to the processing of your personal information in accordance with the Company’s Privacy Policy, including international transfers permitted by law and subject to appropriate safeguards such as Standard Contractual Clauses where required under GDPR.
d. Restrictions on Use. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, including its content, functionality, or access credentials, without the Company’s express written permission.
e. User Responsibilities. You are responsible for ensuring that any information you provide through the Service is accurate, lawful, and does not infringe the rights of any third party. You agree not to use the Service for any unlawful, harmful, fraudulent, or abusive purpose.
6. Modifications to the Service and Prices
Price Changes. Prices for products and services are subject to change at any time without prior notice. The Company may adjust pricing to reflect market conditions, supplier changes, operational costs, or other business considerations. Such changes shall not affect orders that have already been accepted, except where permitted by applicable law.
Modifications to the Service. The Company reserves the right, at any time and without notice, to modify, suspend, or discontinue any part of the Service, including features, functionality, or content. The Company shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
Product Availability, Payment Capture, and Customer Notification. The Company does not capture or collect payment at the time an order is placed. Payment is only captured once the product is prepared for fulfillment and shipment. If a purchased product is found to be out of stock at the time of fulfillment, the Company will not charge the customer for that item.
In such circumstances, the customer will receive an email notification indicating that the product is out of stock. No further action is required from the customer. The Company may, at its discretion, offer the customer the option to substitute the unavailable product with an equivalent or comparable item; however, no substitution will be made without the customer’s express consent.
This process is compliant with applicable consumer protection legislation in Canada, the United States, and other relevant jurisdictions, as no payment is taken for unavailable products and the customer retains full discretion regarding any offered substitution.
7. Products or Services.
Certain products or services may be available exclusively online. These may have limited quantities and are subject to return or exchange according to our Return Policy.
We make every effort to display product colors and images accurately but cannot guarantee monitor accuracy.
We reserve the right to limit sales to any person or region and to limit quantities. All product descriptions and pricing are subject to change without notice.
We do not warrant that product quality will meet your expectations or that errors will be corrected.
8. Accuracy of Billing and Account Information
We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, household, or order.
You agree to provide accurate purchase and account information and to update your information promptly.

We may provide you with access to third‑party tools or services (“Third‑Party Tools”). You acknowledge and agree that Framar does not monitor, control, endorse, or make any representations regarding such Third‑Party Tools. Your use of Third‑Party Tools is entirely at your own discretion and risk.
Framar shall have no liability whatsoever arising from or relating to your use of Third‑Party Tools, including any loss, damage, or data processing carried out by such tools. You are responsible for reviewing and complying with any applicable third‑party terms and privacy policies before using Third‑Party Tools.
Any new tools, services, or features made available through the Service in the future shall also be subject to these

Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating content or accuracy and assume no liability for third-party materials.
Complaints or questions regarding third-party products should be directed to the third-party.
11. User Comments, Feedback, and Submissions
If you submit comments, you agree that we may use them without restriction. We have no obligation to maintain comments in confidence or to compensate you.
We may monitor or remove content deemed unlawful, offensive, or violating intellectual property.
You agree that your comments will not violate any third-party rights or contain unlawful or harmful material.

If any provision is deemed unlawful or unenforceable, the remainder of the Terms shall remain valid.

These Terms are effective unless terminated by you or us. We may terminate this agreement at any time without notice if you fail to comply with any provision.
19. Entire Agreement
These Terms constitute the entire agreement between you and Framar International Inc. Any ambiguities shall not be construed against the drafting party.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada.
21. Duties and Taxes Outside USA and Canada
All customs duties, taxes, and fees for international shipments are the responsibility of the customer.
If you refuse to pay additional fees, your package may be returned and refunded minus any extra shipping charges.
Returned goods must be properly declared to customs. We are not responsible for returns rejected due to incorrect customs declarations.
22. SMS Terms of Service
The Framar mobile message service is operated by Framar International Inc. Use of the Service constitutes agreement to these Mobile Terms.

25. Statutory Warranty Rights (EU, UK, Australia, Brazil)
Nothing in these Terms or in Framar’s commercial return policy limits or excludes any mandatory statutory warranty rights available to consumers under applicable law.
European Union & United Kingdom:
European Union: Consumers are entitled to a minimum two‑year legal guarantee of conformity for goods. Under Directive (EU) 2019/771, any lack of conformity arising within two years is presumed to have existed at the time of delivery, unless proven otherwise. Consumers may request repair, replacement, or refund in accordance with the Directive.
United Kingdom: Under the Consumer Rights Act 2015, consumers benefit from a 30‑day short‑term right to reject faulty goods. For defects arising within six months, the goods are presumed not to have conformed at delivery unless the seller proves otherwise. Consumers may request repair or replacement, and if these fail, a price reduction or refund.
Australia: Under the Australian Consumer Law (ACL), consumers are entitled to guarantees that goods are of acceptable quality, fit for purpose, and match their description. These rights cannot be excluded, and consumers may be entitled to a refund, repair, or replacement for defective goods regardless of Framar’s commercial return period.
Brazil: Under the Brazilian Consumer Defense Code (CDC), consumers have a 90‑day statutory warranty for durable goods. Consumers may request repair, replacement, or refund for defects that render the product unfit for normal use.
26. Security Incident and Breach Notification. Framar implements administrative, technical, and physical safeguards appropriate to the sensitivity of personal information. In the event of a security incident involving personal information, Framar will comply with all applicable breach‑notification laws, including:
(a) notifying supervisory authorities within the timelines required under the GDPR and UK GDPR (including the 72‑hour notification requirement where applicable);
(b) notifying affected individuals where required by law; and
(c) maintaining records of security incidents in accordance with statutory obligations.
28. California Notice at Collection (CCPA/CPRA). At or before the time personal information is collected, Framar provides the following notice to California residents pursuant to the California Consumer Privacy Act (CCPA/CPRA):
Categories of Personal Information Collected: Identifiers; contact information; commercial information; device and usage data; geolocation data; and inferences derived from the foregoing.
Purposes of Collection: To provide and improve the Service; process transactions; deliver orders; personalize content; conduct analytics; prevent fraud; provide customer support; and perform marketing activities.
Sharing: Framar may “share” personal information for cross‑context behavioral advertising as defined under the CPRA. Framar does not “sell” personal information for monetary consideration.
Consumer Rights: California residents may request access, deletion, correction, and may opt out of sharing for targeted advertising. Framar honors Global Privacy Control (GPC) signals where required by law.
